By using or accessing services offered by Better and Better LLC (“Company,” “we,” “us,” or “our”), including booking services, purchasing apparel, attending programs, participating in camps or clinics, consulting, or accessing other offerings (“Services”), you (“Client,” “Participant,” or “User”) agree to these Terms of Service (the “Terms”). If you do not agree with any part of these Terms, you must not use our Services.
1. Services
Better and Better LLC provides athletic training and improvement guidance to individuals, teams, coaches, and programs at all levels. This includes, without limitation:
Clinics & Camps
Personal Training / Private Lessons
Program Improvement for High School, Youth, and Other Teams
Training and Mentoring for Coaches
Assistance in Finding Long-Term Coaches
Apparel and Merchandise Sales
All such offerings are collectively the “Services.”
2. Acceptance of Terms
By booking, engaging in, or accessing any Services, you accept and agree to be bound by these Terms and any additional rules, policies, or guidelines provided at the time of purchase or engagement.
3. Eligibility
To use our Services, you must be at least 18 years old. If you are under 18, you may use our Services only with the consent of a parent or legal guardian who agrees to these Terms on your behalf.
4. Booking, Payments & Fees
You agree to pay all applicable fees associated with the Services you book or enroll in.
Fees must be paid in full prior to the start of the Engagement unless otherwise agreed in writing.
All sales are final unless expressly stated otherwise.
If your payment is declined, we may cancel your booking without notice.
5. Cancellation, Rescheduling & Refunds
Participant Cancellations:
Cancellations more than 48 hours before the scheduled session receive a full refund.
Cancellations within 48–24 hours receive a 50% refund.
Cancellations less than 24 hours before the session are non-refundable.
Frequent short-notice cancellations may incur additional fees.
Coach Cancellations:
Coaches will notify you and attempt to reschedule.
If rescheduling fails, a full refund is provided.
Coaches who cancel multiple times may be temporarily suspended from bookings.
Program/Camp Weather or Conditions:
For outdoor programs, a cancellation due to weather may be rescheduled or refunded based on notice and the length of the program.
6. Assumption of Risk
Participation in athletic training, camps, events, and other Services involves physical activity and inherent risk of injury or harm. By participating, you assume all risks related to participation, and you release Better and Better LLC, its owners, employees, contractors, and affiliates from any liability for injury, loss, or damage arising from participation.
7. Conduct and Safety
Participants and guardians agree to:
Behave professionally and respectfully toward coaches, staff, and fellow participants.
Follow all safety instructions and facility policies.
Not engage in conduct that endangers self or others.
Failure to comply may result in removal from Services, without refund.
8. Intellectual Property
All materials provided by Better and Better LLC — including training programs, documents, guides, proprietary methods, and media — are the Company’s intellectual property. You may not distribute, copy, modify, or use such materials outside the scope of Services without written permission.
9. Merchandise & Apparel
Any merchandise or apparel you purchase as part of our Services is subject to separate policies for returns, sizing, warranties, and delivery. Unless specified, all apparel purchases are final sale.
10. Privacy & Data
We collect and use personal information as described in our Privacy Policy. By using our Services, you consent to that Policy and the collection, use, and storage of your information in accordance with applicable laws.
11. Cancellation by the Company
We reserve the right to cancel or modify Services due to unforeseen circumstances (e.g., weather, facility issues, staffing). In such cases, we will provide notice and offer rescheduling or refunds as appropriate.
12. Limitation of Liability
To the fullest extent permitted by law, Better and Better LLC’s total liability for any claim shall not exceed the amount you paid for the applicable Service. We shall not be liable for indirect, incidental, special, or consequential damages.
13. Indemnification
You agree to indemnify and hold Better and Better LLC and its affiliates harmless from any claims, damages, liabilities, costs, and expenses (including attorneys’ fees) arising out of your use of Services, violation of these Terms, or conduct.
14. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts. Any dispute will be resolved in the state or federal courts located in Massachusetts.
15. Modification of Terms
We may modify these Terms at any time by posting updated terms on our website. Continued use of Services after such changes constitutes acceptance of the new Terms.

LIABILITY WAIVER & PARTICIPATION AGREEMENT

READ CAREFULLY — THIS IS A LEGALLY BINDING RELEASE OF LIABILITY AND WAIVER OF LEGAL RIGHTS THAT IS AGREED UPON WHEN ANY PURCHASE OR AGREEMENT OF A SERVICE HAPPENS.
1. PARTIES
This Agreement is entered into by the undersigned Participant and/or Parent/Legal Guardian (“Participant”) in favor of Better and Better LLC, Garrett Brown, all coaches, independent contractors, employees, volunteers, facilities, property owners, sponsors, and affiliates (collectively “Released Parties”).
2. ACKNOWLEDGMENT OF INHERENT RISK
Participant understands that athletic training, clinics, camps, private lessons, competitions, strength and conditioning sessions, and related activities (collectively “Activities”) involve inherent and significant risks including but not limited to:
Serious bodily injury
Concussion and traumatic brain injury
Permanent disability
Paralysis
Death
Emotional distress
Property loss or damage
Participant knowingly and voluntarily assumes ALL risks, both known and unknown, even if arising from the negligence of the Released Parties.
3. EXPRESS RELEASE & WAIVER OF LIABILITY
To the fullest extent permitted under Massachusetts law, Participant hereby:
Releases and forever discharges the Released Parties
Waives any and all claims
Covenants not to sue
for any injury, loss, or damage arising out of or related to participation in Activities, INCLUDING CLAIMS ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES.
This waiver does not apply to gross negligence or willful misconduct where prohibited by law.
4. INDEMNIFICATION & HOLD HARMLESS
Participant agrees to indemnify, defend, and hold harmless the Released Parties from any claims, liabilities, damages, costs, or attorney’s fees arising from:
Participation in Activities
Violation of rules or policies
Acts or omissions of Participant
This obligation survives the conclusion of participation.
5. MEDICAL REPRESENTATION & AUTHORIZATION
Participant represents they are physically and mentally capable of participating.
Participant authorizes Better and Better LLC to obtain emergency medical treatment if necessary and agrees to bear full financial responsibility for all related medical costs.
Participant confirms disclosure of all relevant medical conditions.
6. CONCUSSION & RETURN-TO-PLAY POLICY
Participant acknowledges:
Head injuries are serious.
Participant may be removed from participation at staff discretion.
Medical clearance may be required before return.
The Company’s decision regarding removal for safety is final.
7. BEHAVIORAL REMOVAL
Better and Better LLC reserves the absolute right to remove any participant for:
Unsafe conduct
Disruptive behavior
Harassment or bullying
Failure to follow instructions
Removal may occur without refund.
8. PHOTO & MEDIA RELEASE
Participant grants irrevocable permission to use photographs and video for marketing, promotional, and business purposes without compensation.
9. LIMITATION OF DAMAGES
If liability is imposed despite this Agreement, Participant agrees that total damages shall not exceed the amount paid for the specific Activity.
Under no circumstances shall Released Parties be liable for consequential, incidental, or punitive damages.
10. ARBITRATION & VENUE
Any dispute arising from this Agreement shall first be submitted to binding arbitration in Massachusetts.
If litigation is required, venue shall exclusively lie in courts located in the Commonwealth of Massachusetts.
Participant waives the right to a jury trial where legally permissible.
11. SEVERABILITY
If any provision is found unenforceable, the remaining provisions remain fully enforceable.
12. ACKNOWLEDGMENT
Participant acknowledges:
This is a legally binding waiver.
Legal rights are being waived.
The Agreement is voluntary.
No oral representations modify this Agreement.

Better and Better LLC ("Company," "we," "us," or "our") is committed to protecting the privacy of every individual who interacts with our services — including athletes, coaches, parents, guardians, and program administrators. • Medical conditions, allergies, or physical limitations disclosed for safety purposes

2. Children's Privacy and Minors Under 18
This section is critically important. Please read it carefully if you are enrolling a child in any Better and Better LLC program, clinic, camp, lesson, or training session.
Better and Better LLC services are open to participants of all ages, including children under the age of 18. We take the privacy and safety of minors extremely seriously. The following policies apply to all participants under 18 years of age:
Parental Consent Is Required
No minor under the age of 18 may participate in any Better and Better LLC service without the express consent of a parent or legal guardian. By completing registration or booking on behalf of a minor, the parent or guardian:
• Acknowledges they have read and agreed to this Privacy Policy in full
• Consents to the collection and use of their child's information as described herein
• Authorizes Better and Better LLC to use photos and video of their child for marketing and promotional purposes (see Section 6), unless they opt out in writing
• Confirms they are the child's parent or legal guardian and have authority to provide this consent

For minor participants, we may collect:

• Parent or guardian's name, address, phone number, and email

• Performance notes or coaching records created during sessions
We collect only the minimum information necessary to safely and effectively deliver our services. We do not collect sensitive personal information about minors beyond what is reasonably required for program participation and safety.
We Do Not Market Directly to Minors
Better and Better LLC does not send marketing communications directly to minors. All marketing communications regarding programs, services, and updates are directed to the parent or guardian on file.
COPPA Compliance
We do not knowingly collect personal information directly from children under the age of 13 through our website without verifiable parental consent. If we learn that we have inadvertently collected information from a child under 13 without parental consent, we will delete it promptly. If you believe we have collected such information, please contact us immediately at the address listed in Section 11.

• To protect the rights, property, and safety of our clients, coaches, staff, and the public
4. How We Share Your Information
Better and Better LLC does not sell, rent, or trade your personal information to third parties. We may share your information in the following limited circumstances:
With Coaches and Contractors
Coaches, trainers, and mentors working with you through Better and Better LLC will have access to the information necessary to deliver your program — including your name, contact information, session notes, and any relevant health disclosures. All coaches and contractors are expected to maintain the confidentiality of participant information.
With Service Providers
We use trusted third-party service providers to operate our business, including payment processors, scheduling platforms, website hosting (Squarespace), and email communication tools. These providers have access to your information only to perform services on our behalf and are required to protect it appropriately.
For Legal Reasons
We may disclose your information if required by law, court order, or government authority, or if we reasonably believe disclosure is necessary to protect the safety of any person or to prevent fraud or illegal activity.
Business Transfers
In the event Better and Better LLC is acquired, merged, or transfers its assets, your information may be transferred as part of that transaction. We will notify you of any such change and your continued use of our services will constitute acceptance.
5. Data Retention
We retain your personal information for as long as necessary to fulfill the purposes for which it was collected, including:
• Active client records are maintained for the duration of your engagement with Better and Better LLC plus a minimum of 3 years thereafter for legal and business purposes
• Signed waivers and consent forms are retained for a minimum of 7 years
• Payment records are retained in accordance with applicable tax and accounting requirements
• Information about minors is retained in accordance with applicable Massachusetts law and deleted upon written request of a parent or guardian, provided no legal obligation requires retention
You may request deletion of your information at any time (see Section 9). We will honor such requests to the extent permitted by law.
6. Photo and Media Use
As acknowledged in our Terms of Service and Liability Waiver, by participating in any Better and Better LLC service, program, clinic, or camp, you grant Better and Better LLC an irrevocable, royalty-free license to use photographs, video recordings, and other media captured during participation for marketing, promotional, and business purposes. This includes use on our website, social media platforms, print materials, and apparel.
For minor participants, this consent is provided by the parent or legal guardian at the time of registration.
OPT-OUT: If you do not consent to photo or media use for yourself or your minor child, you must notify us in writing prior to participation at the contact information listed in Section 11. Verbal opt-outs cannot be guaranteed. Once an image has been published, we cannot guarantee removal from third-party platforms where it may have been shared.
7. Cookies and Website Tracking
Our website is hosted on Squarespace, which may use cookies and similar tracking technologies to improve site performance and user experience. These may include:
• Session cookies that expire when you close your browser

You may withdraw consent for future photo and media use by notifying us in writing. This does not affect media that has already been published.
